Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the SaltSignal mobile application, website, and related services (the “Services”), operated by SaltSignal (“we”, “us”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Not professional advice

The Services provide general information about dive and marine conditions and related topics. This is not professional diving, medical, legal, or meteorological advice. You are solely responsible for evaluating whether any dive or water activity is appropriate for your skills, certification, equipment, and the conditions at the time and place of your activity.

2. Safety and assumption of risk

Diving and water sports involve inherent risks, including serious injury or death. You voluntarily assume all risks associated with your use of information from the Services and with any activities you undertake. Always follow safe diving practices, dive within your training limits, use appropriate equipment, and obtain local, official, and professional guidance where required.

3. Accuracy and availability

Conditions change rapidly. Data may be incomplete, delayed, interpolated, or incorrect. We do not warrant that any information is accurate, complete, current, or suitable for your purpose. Official marine, weather, and safety notices from government and local authorities take precedence over anything shown in the Services.

4. Data sources and attribution

SaltSignal uses third-party data sources, including WillyWeather and the Bureau of Meteorology (BOM). Where required by provider terms, SaltSignal provides source attribution within the app and associated materials.

By using SaltSignal, you acknowledge and agree that:

  • WillyWeather is credited by name and brand logo as a data source where required;
  • BOM attribution is displayed where required by BOM branding and trademark requirements, including the policy at https://www.bom.gov.au/data-access/brand-trademark-display-policy.shtml;
  • source data is provided by third parties and may change without notice; and
  • SaltSignal does not imply sponsorship, endorsement, or affiliation unless explicitly stated.

5. Eligibility

You must be able to form a binding contract under applicable law to use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

6. No accounts

SaltSignal currently does not require user accounts. If account features are introduced in future versions, additional terms may apply.

7. Acceptable use

You must not:

  • use the Services in violation of law or third-party rights;
  • attempt to gain unauthorised access to systems, data, or infrastructure;
  • interfere with or disrupt the Services;
  • reverse engineer, scrape, or overload the Services except as permitted by law;
  • misrepresent your identity or affiliation.

8. Third-party data restrictions

To the extent third-party provider terms apply to data displayed in SaltSignal, you must not remove required attributions, misrepresent the source of data, or use the Services in a way that breaches those provider terms.

Without limiting the above, the Services and their data are not intended for mission-critical use cases (including emergency response, life support, or other safety-critical systems where failure could result in death, injury, or major damage).

9. Intellectual property

We and our licensors own the Services, including software, branding, and content (except where you provide content). We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial use in accordance with these Terms.

10. Third-party services and links

The Services may reference or link to third-party sites or data sources. We are not responsible for third-party content, terms, or practices.

11. Subscriptions and fees

The Services are currently provided free of charge. Paid features or subscriptions may be added in future. If introduced, additional purchase terms (including billing and cancellation) will be presented at that time.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded or limited. Where our liability can be limited, to the extent permitted by law our total liability for loss arising from the Services is limited to re-supplying the Services or paying the cost of re-supply, or (if you paid for a specific paid feature in the relevant period) the amount you paid for that feature in the 12 months before the claim.

13. Disclaimer of warranties

To the maximum extent permitted by law (subject to the Australian Consumer Law section above), the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law (subject to the Australian Consumer Law section above), we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or opportunity, arising from your use of the Services or reliance on any information, including in connection with diving or water activities.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless SaltSignal and its affiliates, directors, and personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services or breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.

16. Suspension and termination

We may suspend or terminate access to the Services if we reasonably believe you have breached these Terms, pose a security risk, or where required by law. You may stop using the Services at any time.

17. Changes

We may modify these Terms. We will post the updated Terms on this page and update the effective date. Continued use after changes constitutes acceptance, except where law requires additional steps.

18. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia (or the State or Territory we nominate in a future update if we incorporate a company in a specific jurisdiction).
